These Terms of Service govern access to the website of Accessoires Kiddocap Inc. as well as the purchase and use of the products offered on it. By accessing the site or purchasing a product, you accept these Terms of Service. Please read sections 8 to 11 carefully before purchasing or using the product.
1. Intellectual Property The Kiddocap helmet is an exclusive invention of Accessoires Kiddocap Inc. and is patent pending under an international patent application (PCT). Its design, concept, appearance and distinctive elements are protected. All elements of the site — including texts, images, logos, visuals, concepts, documents, photographs, graphics, videos and distinctive elements related to the Kiddocap helmet — are the property of Accessoires Kiddocap Inc. or are used lawfully by it. Any unauthorized reproduction, imitation, distribution, adaptation or use, in whole or in part, is strictly prohibited without prior written authorization.
2. About the Kiddocap Helmet The Kiddocap helmet is a protective helmet intended for children aged 1 to 3, built into a bucket-style hat, featuring a rigid ABS shell and EVA foam. It is designed to help cushion minor everyday impacts: bumps, small falls and light knocks in the normal course of a young child's exploration.
3. Intended Use The Kiddocap helmet must be used only according to its intended use — as everyday head protection for a child aged 1 to 3, in a normal context and under the direct supervision of an adult. It does not replace adult vigilance, a suitable and safe environment, or specialized equipment when such equipment is required. The Kiddocap helmet is designed for children aged 1 to 3 with a head circumference between 46 and 52 cm. The product must be properly adjusted, in accordance with the instructions provided. A product that is improperly adjusted, or used outside the intended age or size range, may not provide the expected protection.
4. Orders, Prices and Availability All prices are indicated in Canadian dollars (CAD), unless otherwise indicated. Taxes, shipping fees and other applicable charges are indicated at checkout. We make reasonable efforts to describe our products accurately; however, minor differences in colour, finish or presentation may exist between the images displayed and the product received. We reserve the right to modify, suspend or withdraw a product, to limit quantities, or to correct any error in a description, price or displayed information, subject to applicable law. We also reserve the right to refuse, limit or cancel any order, in particular in the event of an error, incomplete information, suspected fraud, a payment issue or stock unavailability. Shipping and delivery are governed by our Shipping Policy, published on the site. We currently deliver only within Canada; the timeframes indicated are estimates only.
5. Returns and Refunds Returns, exchanges and refunds are governed by our Return and Refund Policy, published separately on the site. The Kiddocap helmet is also covered by a Lifetime Guarantee against breakage occurring during normal use that compromises the use of the product. The full conditions of this guarantee (proof of purchase, return of the broken part, shipping costs) are described in our Return and Refund Policy. This guarantee is in addition to the protections provided by law and does not limit them in any way.
6. External Links and Third-Party Services The site may contain links to third-party sites or allow the use of third-party services. Accessoires Kiddocap Inc. is not responsible for the content, policies or practices of these third parties.
7. Changes Accessoires Kiddocap Inc. may modify these Terms of Service at any time. The version in effect is the one published on the site at the time of consultation.
Capacity and Severability. By placing an order, you confirm that you are of legal age and have the legal capacity to enter into a contract. If any provision of these terms is found to be invalid or unenforceable, the remaining provisions remain in full force and effect.
8. Important Safety Information and Assumption of Risk The Kiddocap helmet is not a certified helmet. It has not been certified or approved under any bicycle, sports, motorized sports, recreational or impact-protection helmet standard, and must not be used as a replacement for such certified equipment. Although its rigid shell has undergone impact and penetration resistance testing, these tests do not constitute certification to a helmet standard. The Kiddocap helmet complements, but does not replace, adult supervision and a safe environment. By purchasing and using the Kiddocap helmet, you acknowledge and accept the following:

The Kiddocap helmet is intended solely to serve as everyday head protection for children aged 1 to 3, used as described in these Terms and always under the direct supervision of an adult.

No product, including the Kiddocap helmet, can prevent all injuries or guarantee protection in all situations.

Although the Kiddocap helmet was designed and developed to offer the most effective head protection possible for toddlers, no helmet — including the Kiddocap helmet — can claim to prevent concussions or head trauma, nor guarantee a reduction of their risk. No helmet manufacturer can legitimately make such a promise.

The Kiddocap helmet is designed only to help reduce the effect of minor everyday impacts. It is not designed for significant impacts or for the activities listed in section 9, and does not provide protection against them.

The Kiddocap helmet is not a medical device and makes no medical or health claims.

The Kiddocap helmet does not replace adult supervision, a safe environment, or certified equipment when such equipment is required or recommended.

You assume the responsibility of using the product within its intended use and of supervising the child at all times.
9. Limits of Use Although the Kiddocap helmet is designed to help cushion certain minor everyday impacts within its intended use, no product can guarantee absolute protection against all injuries or in all situations. The Kiddocap helmet is not intended to be used for, and must not be used for:

cycling;

skating;

skateboarding;
-
scooters, balance bikes or ride-on toys with speed;

motorized sports or vehicles of any kind;

contact sports;

falls from height;
-
any activity requiring certified or approved protective equipment.
It must also not be used outside the normal scope of its intended use, or in an environment presenting an increased risk of snagging, strangulation or entrapment.
10. Safe Use and Inspection The Kiddocap helmet must always be used under the direct supervision of an adult. Before each use, check the general condition of the product and stop using it if any component shows a visible sign of damage, breakage, deformation or abnormal wear, or after any significant impact. The product must be used in accordance with the instructions, warnings and recommendations communicated by Accessoires Kiddocap Inc.
11. Limitation of Liability To the fullest extent permitted by applicable law, Accessoires Kiddocap Inc., as well as its officers, employees and suppliers, cannot be held liable for direct, indirect, incidental, special or consequential damages resulting in particular from:

use of the product not in accordance with its intended use;

use of the product in an activity excluded under section 9;

the absence of appropriate adult supervision;

use of a damaged, worn or modified product;

use outside the intended scope;

failure to follow the applicable instructions, warnings or recommendations.
Nothing in these Terms of Service is intended to exclude, limit or modify any right, warranty or remedy that cannot be excluded, limited or modified under applicable law, including applicable consumer protection legislation in Quebec and Canada.
12. Governing Law These Terms of Service are governed by the applicable laws of the Province of Quebec and the laws of Canada applicable therein.
