Terms of service

These Terms of Service govern access to the site of Accessoires Kiddocap Inc. and the purchase and use of the products offered on it. By accessing the site or purchasing a product, you accept these Terms of Service. Please read Sections 1, 2, 7 and 8 carefully before purchasing or using the product.

1. About the Kiddocap

The Kiddocap is a protective helmet for children aged 1 to 3, built into a bucket-style hat, with a rigid ABS shell and EVA foam. It is designed to help cushion minor everyday impacts — bumps, small falls and knocks — within the normal context of a young child's exploration.

The Kiddocap is not a certified helmet. It has not been certified or approved under any bicycle, sports, motorized, recreational or impact helmet safety standard, and it must not be used as a substitute for any such certified equipment. While its rigid shell has undergone impact and penetration-resistance testing, this testing does not constitute certification to any helmet standard.

The Kiddocap complements — and does not replace — the supervision of an adult and a safe environment.

2. Important safety information and assumption of risk

By purchasing and using the Kiddocap, you acknowledge and accept the following:

  • The Kiddocap is intended only as everyday head protection for children aged 1 to 3, used as described in these Terms and always under the direct supervision of an adult.

  • No product, including the Kiddocap, can prevent all injuries or guarantee protection in every situation.

  • The Kiddocap is designed only to help reduce the effect of minor everyday impacts. It is not designed for, and does not protect against, serious impacts or the activities listed in Section 7.

  • The Kiddocap is not a medical device and makes no medical or health claim.

  • The Kiddocap does not replace adult supervision, a safe environment, or certified equipment where such equipment is required or recommended.

  • You assume responsibility for using the product within its intended scope and for supervising the child at all times.

3. Intended use

The Kiddocap must be used only according to its intended use — as everyday head protection for a child aged 1 to 3, in a normal daily context, under the direct supervision of an adult. It does not replace the vigilance of an adult, a suitable and safe environment, or specialized equipment when such equipment is required.

4. Orders, pricing and availability

All prices are shown in the applicable currency at the time of purchase, unless otherwise indicated. Taxes, delivery fees and other applicable fees are shown at checkout. We make reasonable efforts to describe our products accurately; however, minor differences in color, finish or presentation may exist between the images shown and the product received. We reserve the right to modify, suspend or withdraw a product, limit quantities offered, or correct any error in a description, price or information shown on the site, subject to applicable laws. We also reserve the right to refuse, limit or cancel any order, in particular in the event of an error, incomplete information, suspected fraud, a payment problem or stock unavailability.

5. Returns and refunds

Returns, exchanges and refunds are governed by our Return and Refund Policy, published separately on the site.

6. Intellectual property

All elements of the site — including texts, images, logos, visuals, concepts, documents, photographs, graphics, videos and distinctive elements related to the Kiddocap — are the property of Accessoires Kiddocap Inc. or are used lawfully by it. Any reproduction, imitation, distribution, adaptation or unauthorized use is prohibited without prior written authorization.

7. Limits of use

Although the Kiddocap is designed to help cushion certain minor everyday impacts within its intended use, no product can guarantee absolute protection against all injuries or in all situations. The Kiddocap is not intended to be used for, and must not be relied upon for:

  • cycling;

  • skating;

  • skateboarding;

  • scooters, balance bikes or ride-on toys at speed;

  • motorized sports or vehicles of any kind;

  • contact sports;

  • falls from height;

  • any activity requiring certified or approved protective equipment.

It must also not be used outside the normal context of its intended use, or in any environment presenting an increased risk of snagging, strangulation or entrapment.

8. Safe use and inspection

The Kiddocap must always be used under the direct supervision of an adult. Before each use, check the general condition of the product and stop using it if any component shows a visible sign of damage, breakage, deformation, or abnormal wear, or after any significant impact. The product must be used in accordance with the instructions, warnings and recommendations provided by Accessoires Kiddocap Inc.

9. Limitation of liability

To the fullest extent permitted by applicable law, Accessoires Kiddocap Inc., together with its officers, employees and suppliers, shall not be liable for any direct, indirect, incidental, special or consequential damages arising from:

  • non-conforming use of the product;

  • use of the product in an activity excluded under Section 7;

  • the absence of appropriate adult supervision;

  • the use of a damaged, worn or modified product;

  • use outside the intended scope;

  • failure to follow the applicable instructions, warnings or recommendations.

Nothing in these Terms of Service excludes, limits or modifies any right, warranty or remedy that cannot be excluded, limited or modified under applicable law, including applicable consumer-protection legislation in Quebec and Canada.

10. External links and third-party services

The site may contain links to third-party sites or allow the use of third-party services. Accessoires Kiddocap Inc. is not responsible for the content, policies or practices of these third parties.

11. Changes

Accessoires Kiddocap Inc. may modify these Terms of Service at any time. The version in force is the one published on the site at the time of consultation.

12. Governing law

These Terms of Service are governed by the laws applicable in the province of Quebec and the laws of Canada that apply.
